The legal position in brief
GST Registration Patna is generally applied for electronically in FORM GST REG-01. The
application may be examined by the proper officer, who can issue FORM GST REG-03
seeking specified clarification or documents; the applicant responds through FORM GST
REG-04.
If the response is not satisfactory, or is not filed within the applicable period, the
application may be rejected through FORM GST REG-05, with reasons
recorded. A rejection is not necessarily the end of the matter — depending on the
order, facts and available statutory remedies, an appeal or, in appropriate cases,
judicial review may need to be considered.
What is GST Registration Patna?
GST Registration Patna is the statutory process through which a person who is liable to
be registered under the GST framework obtains a GSTIN and becomes a registered person
for Bihar or the relevant Union territory.
The question is not simply whether a business has a GST number. First, it must be
determined whether registration is legally required. Sections 22, 23 and
24 of the CGST framework deal with persons liable, persons not liable and
specified cases of compulsory registration. Section 25 deals with the
procedure for registration.
A person who is not otherwise liable may also seek voluntary registration in
circumstances permitted by the Act. Once voluntarily registered, the statutory
obligations applicable to a registered person generally follow.
The turnover threshold should not be treated as the only test. The nature of supplies,
inter-State supplies, e-commerce-related provisions, notified categories and other
compulsory-registration provisions can change the result.
For that reason, a business in Patna should determine its registration liability from
the current law and applicable notifications, rather than relying on a single turnover
figure copied from an older article.

Call the ChamberWho may need GST Registration Patna?
The registration analysis for GST Registration Patna generally begins with:
- Aggregate turnover and taxable supplies
- Nature of the business
- Goods, services or mixed supplies
- State or Union territory from which supplies are made
- Whether a compulsory-registration provision applies
- Whether the person falls within an exemption under the Act or notification
- Whether an earlier GST registration exists or was cancelled
The general threshold framework has changed over time, including the notified higher
threshold for eligible suppliers engaged exclusively in supply of goods. Bihar-specific
applicability should therefore be checked against the current notifications and the
exact nature of the taxpayer's supplies.
Do not assume that a business below a commonly quoted turnover threshold is
automatically outside the registration requirement. Compulsory-registration provisions
and specific exemptions can affect the answer.
GST Registration Patna process
Step 1: Determine whether registration is required
Before filing an application, identify the legal basis for registration. This is
important because the application asks for information such as the date of commencement
of business and the date on which the liability to register arose. The GST Portal also
validates PAN and requires relevant authentication.
Step 2: File FORM GST REG-01 for GST Registration Patna
For a normal taxpayer, the application begins with FORM GST REG-01 on
the GST Portal. Part A requires details including PAN, legal name, State or UT, mobile
number and email address. After verification, the portal generates a Temporary Reference
Number (TRN), which is used to continue the application.
The legal name should correspond with the PAN records. The trade name and legal name
should not be confused.
Step 3: Complete authentication requirements
Registration in Patna may involve Aadhaar-based authentication or, depending on the
taxpayer and circumstances, biometric or other verification. The current GST Portal
explains that authentication can depend on the constitution of the business and risk
parameters. In specified cases, applicants may be required to visit a designated GST
Suvidha Kendra for biometric or document verification.
A failure to complete a required authentication step can affect whether the application
is treated as properly submitted and whether an ARN is generated.
Step 4: Upload the required documents
The documents depend on the constitution of the business and the principal place of
business. CBIC's 2025 registration instruction is particularly important here. It states
that officers should follow the indicative document list in REG-01 and should not
routinely demand unnecessary additional documents.
Step 5: Examination by the proper officer
The proper officer examines the application and supporting information. If the
application is complete and satisfactory, registration may be approved. If clarification
or additional information is legitimately required, the officer may issue
FORM GST REG-03. The applicant then responds through
FORM GST REG-04.
Step 6: Approval or rejection
Where the officer is satisfied with the response, the application may proceed to
registration and FORM GST REG-06 is the registration certificate.
Where the reply is absent or unsatisfactory, the officer may issue
FORM GST REG-05, rejecting the application and recording reasons.

The exact document list depends on the business structure and premises.
Documents by business structure and premises| Situation | Typical evidence identified by CBIC |
|---|
| Owned premises | Property-tax receipt, municipal khata, electricity bill or comparable document establishing ownership |
| Rented or leased premises | Valid rent or lease agreement plus prescribed ownership evidence of lessor |
| Registered lease | Lease agreement plus prescribed ownership evidence; CBIC states additional lessor identity proof should not ordinarily be demanded |
| Unregistered lease | Agreement plus ownership evidence and, in specified circumstances, lessor identity proof |
| Premises held by spouse, relative or other person | Consent letter, identity proof of consenter and ownership evidence |
| Shared premises | Appropriate agreement or consent and ownership or possession evidence |
| Partnership | Partnership deed |
| Company, LLP or other entity | Constitution or incorporation evidence and authorised-signatory information |
| Photograph or bank information | Details and documents requested in the applicable REG-01 fields |
CBIC's 17 April 2025 instruction expressly addresses proof of the
principal place of business and constitution of business. For example, it states that
where a partnership applicant is a partner, the partnership deed is relevant and
additional documents such as Udyam or MSME or shop-establishment certificates should
not ordinarily be demanded merely as proof of constitution.
The document list should nevertheless be checked against the current REG-01
application, because portal requirements and notified procedures can change.
Why can a GST Registration Patna application be rejected?
A GST Registration Patna application can be rejected for different reasons, including:
- Incomplete or illegible documents
- Discrepancies between the application and supporting documents
- Inadequate proof of the principal place of business
- Problems concerning the constitution of the business
- Unresolved clarification sought through REG-03
- Failure to respond within the applicable period
- An unsatisfactory response
- Issues connected with an earlier GST registration
- Circumstances requiring further verification that have not been satisfactorily addressed
CBIC's 2025 instruction specifically directs officers to scrutinise whether documents
are legible, complete and relevant, and whether the information in the application
corresponds with the uploaded documents. It also cautions officers against presumptive
queries unrelated to the documents or information supplied by the applicant.
An important distinction: deficiency notice versus rejection order
A REG-03 notice is not itself the final rejection. It is a request for
clarification, information or documents. The applicant should therefore read the notice
carefully and respond to each issue through REG-04, with supporting material where
appropriate.
A later REG-05 is the rejection order. The legal response to a REG-05
therefore differs from the response to a REG-03.
What should you do after receiving a REG-03 notice for GST Registration Patna?
Do not treat a REG-03 notice as a routine document request. First identify:
- The ARN or application involved
- The exact deficiency identified
- The date of receipt of the notice
- The response deadline
- Each document or clarification requested
- Whether the request appears connected to the information supplied
- Whether a previous GSTIN or cancellation is relevant
The current CBIC Instruction No. 03/2025-GST states that the applicant
is required to furnish the reply in FORM GST REG-04 within seven working
days from receipt of the REG-03 notice. The GST Portal's current guidance also
refers to a seven-working-day reply period.
Do not calculate the deadline merely by counting seven calendar days. The actual date
should be calculated from the portal record and the applicable rules and instructions.
Seven working days, not seven calendar days
The REG-03 response window runs on working days. A reply filed after the deadline can
result in REG-05 rejection. Where the officer's query is presumptive or goes beyond
the documents supplied, the reply should identify the objection explicitly.

The chamber files REG-04 replies within the seven-working-day window.
Urgent Reply AssistanceWhat happens after GST Registration Patna is rejected through REG-05?
The first task is to obtain and preserve the complete electronic record:
- REG-01 application
- ARN
- REG-03 notice
- REG-04 response
- Documents uploaded
- Authentication records
- Portal correspondence
- REG-05 order
- Details of any previous GST registration
Then determine whether the rejection is based on a factual deficiency, an unresolved
statutory issue, an earlier cancelled registration, or a procedural defect.
A REG-05 order should contain reasons. CBIC's 2025 instruction states that where the
officer is not satisfied with the clarification or documents, the application may be
rejected for reasons to be recorded in writing.
This requirement matters because the applicant needs to know what decision was actually
made and why.
Is an appeal possible against GST Registration Patna rejection?
A statutory appeal under Section 107 of the CGST Act is an important
remedy to examine where an appealable decision or order has been passed by an
adjudicating authority.
Section 107(1) generally provides a three-month period from the date on
which the decision or order is communicated. Section 107(4) permits the Appellate
Authority, where sufficient cause is shown, to allow filing within a further period of
one month.
The GST Portal also provides an appeal mechanism and identifies
FORM GST APL-01 as the taxpayer's appeal form.
However, the correct remedy should be determined from the exact REG-05 order and
procedural history. The rejection of a fresh application is not always the same as the
rejection of a first registration — where the order is connected with an earlier
cancellation, the proper remedy may involve analysing revocation of cancellation and/or
an appeal against the relevant cancellation or subsequent order.
What about filing a writ petition for GST Registration Patna?
A writ petition under Article 226 is not an automatic substitute for
the statutory appeal process.
A High Court may exercise writ jurisdiction in an appropriate case, but whether it
should do so depends on the facts, the availability and adequacy of an alternative
remedy, procedural fairness, jurisdictional issues and the nature of the impugned
action.
For example, the Patna High Court in
M/s Maharaj Ji Enterprises v. Union of India, CWJC No. 15175 of 2024, decided
on 16 July 2025, considered a fresh registration rejection following an earlier
cancellation. The Court found the rejection order unreasoned and remitted the matter for
fresh consideration rather than simply treating the petitioner as automatically
entitled to registration.
The decision is particularly relevant to Bihar because the dispute concerned the Bihar
GST administration. The Court also considered the relationship between a previous
cancellation, a fresh application and CBIC Circular No. 95/14/2019-GST.
This is a fact-specific judgment, not a blanket rule
The Patna High Court has been willing to interfere where a rejection order is
unreasoned. But the Court has not laid down that every REG-05 order should be
challenged through a writ petition. The exact application, notice, documents,
previous GST history and reasons recorded by the officer remain important.
Earlier GST Registration Patna cancelled? Do not simply file a fresh application
This is one of the more important issues in registration disputes in Patna.
If an earlier GSTIN associated with the same PAN was cancelled, the applicant should
identify:
- Why the earlier registration was cancelled
- The effective date of cancellation
- Whether cancellation was for non-filing of returns or another ground
- Whether revocation was available
- Whether a revocation application was filed
- Whether an appeal was filed
- Whether outstanding returns and statutory dues remain
- Whether the fresh application has been affected by the earlier cancellation
In Maharaj Ji Enterprises, the Patna High Court observed that a fresh
application was not itself barred, but the proper officer was required to consider the
relevant statutory circumstances and record the required finding. The Court set aside
the unreasoned rejection and remitted the application for fresh consideration.
This illustrates why a fresh application should not be analysed independently of the
taxpayer's previous GST history.

Get History AnalysisGST Registration Patna: local authorities and practical context
GST registration in Patna is primarily governed by the national GST framework together
with the applicable Bihar State GST legislation, rules, notifications and
administrative instructions.
For a taxpayer in Patna, the practical record may involve the relevant Central GST and
Bihar State Tax authorities, depending on jurisdiction and the nature of the proceeding.
The CGST Patna-I and Patna-II Commissionerates exercise jurisdiction
over different territorial areas within Patna. A business in Kankarbagh may fall under
one Commissionerate, while a business in Danapur or Phulwari Sharif may fall under
another.
An applicant may also deal with the Bihar GST authorities for State-level registration
aspects, including verification of premises and documents under the Bihar Goods and
Services Tax Act, 2017.
The Patna High Court's decision in Maharaj Ji Enterprises is a useful
Bihar-specific example of judicial scrutiny of a registration rejection. The existence
of a Bihar judgment does not mean that the same result will follow in every dispute.
The exact application, notice, documents, previous GST history and reasons recorded by
the officer remain important.
Where the matter proceeds to appeal, the GSTAT Patna Bench is the sole
bench for Patna and all 38 districts of Bihar. Where constitutional jurisdiction is
properly invoked, the Patna High Court may become relevant.
Local documents commonly encountered in Patna include Patna Municipal Corporation
property tax receipts, Bihar State Electricity Board or NBPDCL/SBPDCL electricity bills,
registered lease deeds from the Patna Registry Office, and consent letters from premises
owners in Kankarbagh, Boring Road, Patliputra, Rajendra Nagar, Bakarganj and other Patna
localities.
An application should therefore be prepared with the local jurisdictional officer, the
local premises documentation and the Bihar-specific administrative context in mind.

Frequently Asked Questions about GST Registration Patna
How long does GST Registration Patna take?
The applicable processing period depends on the nature of the application,
authentication, risk parameters and whether physical verification is required.
CBIC's 2025 Instruction No. 03/2025-GST describes approval within seven working
days for complete, non-risk applications and a 30-day framework for specified
physical-verification cases. The current GST Portal guidance similarly refers to
seven working days and, in specified authentication or verification circumstances,
a 30-calendar-day framework.
What is REG-03 in a registration in Patna?
REG-03 is a notice seeking additional information, clarification or documents
concerning a GST registration application. The applicant normally responds
electronically in REG-04.
What is REG-04 in a registration in Patna?
REG-04 is the electronic response used by an applicant to furnish the clarification,
information or documents sought in REG-03.
What is REG-05 in a registration in Patna?
REG-05 is an order rejecting the relevant GST application where the statutory
conditions for rejection are met. In the registration context, reasons are required
to be recorded.
Can I apply again after a registration in Patna is rejected?
A fresh application may be possible in appropriate circumstances, but it should not
be treated as a universal solution. If an earlier GST registration was cancelled,
the earlier cancellation and available revocation or appeal remedies may be
material. The Patna High Court's 2025 decision in Maharaj Ji Enterprises
demonstrates the importance of examining that history.
Can I appeal against a rejection in Patna?
A statutory appeal should be examined where the impugned decision or order falls
within the appellate framework. Section 107 generally provides three months from
communication of the decision or order, with a further one-month period available
for sufficient cause. The precise appealability and filing route should be checked
against the actual order and current GST Portal functionality.
Should I directly file a writ petition after rejection in Patna?
Not automatically. The availability of a statutory appeal is important, and High
Court writ jurisdiction is discretionary. A writ may become relevant where the
facts disclose an appropriate public-law issue, such as a serious procedural or
jurisdictional defect, but the correct remedy requires case-specific assessment.
What documents are required for GST registration in Patna?
The documents vary according to the constitution of the business and the premises.
Proof concerning the principal place of business, constitution, authorised persons
and other REG-01 information may be required. CBIC's 2025 instruction provides
detailed guidance concerning acceptable premises documents and limits on
unnecessary document demands.
