The GSTAT Patna Bench is governed by Section 112 of the CGST/BGST Act, 2017 and the GSTAT (Procedure) Rules, 2025. Section 112 provides the substantive right of second appeal. The Procedure Rules prescribe the forms, timelines and filing procedure.

Practical point on GSTAT Patna Bench documents
The strength of a GSTAT Patna Bench appeal lies in the documents and the grounds. The GSTAT Patna Bench documents must be indexed, paginated and cross-referenced to each ground of appeal. An improperly drafted affidavit is one of the most common reasons for registry defect.
The Patna High Court has developed significant precedent on the GSTAT Patna Bench, particularly during the period when the tribunal was not constituted.
The Patna High Court held that where an appeal under Section 112 could not be filed because the GSTAT Patna Bench was not constituted, the taxpayer was entitled to a stay of recovery on payment of 10% of the disputed tax. The Court directed that the stay would continue until the bench became functional, and the taxpayer must file the appeal within the prescribed period once the bench became operational.
The Patna High Court in SAJ Food Products established the framework for protective orders during the GSTAT vacuum. The Court allowed stay of recovery upon deposit of 20% of the disputed tax, which was later reduced to 10% following the amendment to Section 112(8) effective 1 November 2024.
The Patna High Court, in a writ petition decided on 29 October 2024, recognized that Parliament amended Section 112 of the CGST Act to reduce the pre-deposit from 20% to 10%. The Court held that taxpayers should not be compelled to deposit the higher amount merely because the GSTAT Patna Bench was unavailable. The Court directed that payment of 10% would entitle the taxpayer to a stay on recovery.
The Patna High Court sought responses from the Centre and the Bihar Government on a Public Interest Litigation seeking establishment and availability of the GSTAT Patna Bench. The Court examined whether the remote location of the bench was causing hardship to taxpayers from across Bihar.

Where the Patna High Court order is challenged, or where the GSTAT Principal Bench order is involved, a Special Leave Petition under Article 136 may be filed before the Supreme Court. For State Bench orders, the High Court is the first appellate forum.
Where the GSTAT Patna Bench allows the appeal in full, the pre-deposit made under Section 112(8) is refunded with interest under Section 115. The refund is processed through the Electronic Cash Ledger.
